SWSS Terms and Conditions
By booking swimming lessons with South West Swimming School Ltd, you agree to abide by the following Terms & Conditions:
1. Admission Rights
- South West Swimming School Ltd reserves the right to restrict admission at its sole discretion to ensure the safety and enjoyment of all participants.
2. Missed Lessons & Attendance
- No refunds or credits will be provided for unattended lessons, including in cases where a venue transfer is necessary due to operational reasons. Where available a makeup class will be offered but this is not always guaranteed. And only offered upon notification of absent prior to lesson.
3. Refund Policy & Consumer Rights
- Once a booking has been confirmed, refunds are NOT available. This does not affect your statutory rights under the Consumer Rights Act 2015, which allows for refunds in cases of services not delivered as described or with reasonable care and skill.
4. COVID-19 Local Lockdowns
- In the event of a local lockdown due to COVID-19 or government-mandated closure, we will issue a credit for paid lessons, which can be used for future courses. This credit is non-refundable.
5. COVID-19 Isolation & Long-Term Injury
- If lessons are missed due to COVID-19 isolation or a long-term injury, a credit for future courses may be issued upon submission of a valid medical report. This credit is non-refundable and non-transferable.
6. Child Supervision & Safeguarding
- All swimmers must be supervised by a responsible adult at ALL times before, during, and after each session. This policy aligns with UK child safeguarding laws to ensure the safety of all participants.
7. Changing Facilities & Privacy
- Only children under the age of 8 may be accompanied by a parent/guardian in changing facilities.
- Adults assisting children should use the changing room that aligns with their own gender.
- Children with special needs may require additional changing supervision and may be older than 8 years. In such cases, prior arrangements should be made with South West Swimming School Ltd to ensure appropriate support is provided.
- All customers must respect the privacy of others when using shared facilities, in line with UK data protection and safeguarding regulations.
8. Photography & Video Recording
- The use of cameras, video recording devices, or mobile phones in changing rooms and poolside areas is strictly prohibited to comply with child protection regulations.
- South West Swimming School Ltd may record sessions for training purposes with prior consent from all parties involved.
9. Food & Drink Restrictions
- To maintain hygiene and safety standards, no food may be consumed at any of our venues, including poolside areas and changing facilities. This restriction applies to all areas within the venue.
10. Parental Responsibility & Conduct
- Parents/guardians are responsible for the supervision and behaviour of all children and spectators while on the premises.
- Any behaviour deemed disruptive, inappropriate, or abusive by a swimmer, parent, or carer may result in exclusion from the course without refund.
11. Instructor Availability
- While we strive to maintain continuity in teaching staff, we cannot guarantee the same instructor for every session. Instructors may change due to operational requirements.
12. Personal Belongings & Liability
- All personal property is left at the owner’s risk. South West Swimming School Ltd accepts no liability for lost or stolen items.
- Customers are advised not to bring valuables to the venue.
13. Parking Availability & Vehicle Liability
- Strict No Parking Policy: Strictly no parking is permitted at any of our venues, except for Blue Badge holders.
- Blue Badge Holder Parking: Blue Badge holders requiring parking must contact our office in advance to arrange suitable parking accommodations.
- Vehicle Liability: Vehicles are parked at the owner’s risk. South West Swimming School Ltd accepts no liability for any loss, theft, or damage to vehicles or their contents while parked on-site at any of our venues. Vehicle owners park at their own risk.
14. Course Cancellation & Refunds
- We reserve the right to cancel a course due to insufficient bookings. In such cases, a full refund or alternative booking option will be offered.
- If a course is cancelled by us for any reason (excluding COVID-19 closures), a refund will be processed in compliance with UK consumer protection laws.
15. Payments & Acceptance of Terms
- All bookings are confirmed upon payment. By making a payment, you agree to these Terms & Conditions.
- Payments must be made via approved methods, and all transactions are subject to our Privacy Policy and UK financial conduct regulations.
16. Information Accuracy & Changes
- All information provided is correct at the time of publication but may be subject to change.
- ustomers will be notified of any material changes affecting their booking.
17. Toilet Use Before and During Sessions
- Parents/guardians are encouraged to ensure that children use the toilet before the start of each session to minimise disruptions.
- If a child needs to use the toilet during a session, the parent/guardian must be available to assist, as instructors are not responsible for escorting children to the toilet during lessons.
18. Swim Attire Requirements
- All children are required to wear a South West Swimming School swimming hat and suitably fitted goggles during lessons to ensure safety and hygiene.
- For children with sensory sensitivities, fabric swimming hats are available upon request. Please inform us in advance if your child requires a fabric hat so we can make the necessary arrangements.
19. Cancelled sessions by South West Swimming School & Course Duration
- If we cancelled sessions, it will automatically roll over, adding an additional swim to the course booking. This may extend the course beyond the originally scheduled finish date.
- Please be aware that this extension is subject to instructor availability and venue scheduling. We will make reasonable efforts to accommodate the additional session within the available timeframe.
